MEDIJSKA SCENA SRBIJE U SEPTEMBRU 2014 – MONITORING IZVEŠTAJ br. 56:

• Sloboda izražavanja – Odabrani slučajevi pritisaka, pretnji i napada na novinare i medije koji su obrađeni u ovom izveštaju: pretnje na Fejsbuku novinarima niškog portala „Južne vesti” i verbalni napad zamenika gradonačelnika Niša na novinara tog portala; pritisak lokalnog funkcionera na somborski Internet portal „SOinfo” zbog komentara na Internet forumu tog portala; pritisak na novosadsku štampariju „Grafoprodukt”, tj. blokada računa i njeno zatvaranje koje je u mogućoj vezi sa tekstovima objavljenim u jednom od nedeljnika koje ta štamparija štampa; fizički napadi na fotoreportera „Blica” i na zgradu B92 tokom Parade ponosa u Beogradu; spor između TV B92 i Olje Bećković i prestanak emitovanja emisije „Utisak nedelje” na toj televiziji. U okviru dela sudski postupci analizirane su dve sudske odluke: odluka Apelacionog suda u Novom Sadu u sporu sekretarke bečejskog Udruženja gorana Marije Miković protiv lista „Bečejski mozaik, koja nije povoljna za medij – u ovom sporu postavlja se pitanje razlikovanja vrednosnih i činjeničnih sudova; presuda Osnovnog suda u Valjevu u sporu novinarke Darije Ranković protiv bivšeg gradskog funkcionera u Valjevu Dragoljuba Krstića – jedan od slučajeva u kojima je srpsko pravosuđe odgovorilo na napade na novinare;
• Implementacija postojećih zakona – Zakon o elektronskim medijima – pravila za obračunavanje naknade za emitovanje RTV programa po starom Zakonu o radiodifuziji i po novom Zakonu o elektronskim medijima; Zakon o javnim medijskim servisima – kako RTS tumači Zakon u pogledu roka u kom treba da budu izabrani novi generalni direktor i glavni i odgovorni urednik RTS-a;
• Usvajanje novih zakona – zbog čega je donošenje novog Zakona o oglašavanju, čija izrada je počela, bitno za medije;
• Rad nadležnih organa – Poverenik za informacije od javnog značaja i zaštitu podataka o ličnosti – kako se primenjuje Zakon o slobodnom pristupu informacijama, prema oceni Poverenika, i čemu treba težiti u narednom periodu;
• Proces digitalizacije – zbog čega su sastanci nadležnih organa sa emiterima i sa proizvođačima i trgovcima televizijskih prijemnika, održani u septembru, važni, i koje zamerke u pogledu sprovođenja priprema za prelazak na digitalno emitovanje i dalje ostaju;
• Proces privatizacije medija – kako Agencija sprovodi postupke kojima se ulazi u privatizaciju preostalih medija u javnoj svojini; koji rok za privatizaciju medija važi – prema opštem ili posebnom zakonu;
• Zaključak Izveštaja – autori analiziraju šta je i kako obeležilo medijski sektor u septembru 2014.

II IZVEŠTAJ SA DESETOG MONITORING OKRUGLOG STOLA

Deseti monitoring okrugli sto ANEM-a održan je u Beogradu 20. oktobra 2014. godine. Na tom skupu javno je predstavljena Deseta Monitoring Publikacija ANEM-a koja sadrži tekstove o važnim medijskim pitanjima – novim medijskim zakonima; slobodi izražavanja na Internetu; finansiranju medija; medijima u funkciji javnosti krivičnog postupka. Publikaciju su predstavili autori tekstova, nakon čega je vođena konstruktivna diskusija o temama koje su obrađene u Publikaciji. Događaju je prisustvovao veliki broj zainteresovanih strana – oko 40 učesnika. Izveštaj sa okruglog stola dostupan je ovde.

NEWLY PUBLISHED ON ANEM WEBSITE:
MONITORING REPORT 56 – SEPTEMBER 2014; REPORT ON THE TENTH MONITORING ROUND TABLE!

I SERBIAN MEDIA SCENE IN SEPTEMBER 2014 – MONITORING REPORT No. 56:

• Freedom of expression – Selected cases of pressures, threats and assaults against journalists and media covered in this report: threats on Facebook against journalists of the Nis media portal ”Juzne vesti” and a verbal attack by the Nis deputy mayor on the portal’s journalist; pressure by a local official on the Sombor web portal ”SOinfo” because of comments on the portal’s forum; pressure on the Novi Sad printing press ”Grafoprodukt”, e.g. blocking of its bank account and closing down the printing press that is possibly in relation to the articles published in a weekly that ”Grafoprodukt” prints; physical assaults on a photo-journalist of daily ”Blic” and the B92 building during Pride in Belgrade; conflict between TV B92 and Olja Beckovic and discontinuation of the program ”Utisak nedelje” on TV B92. In the Report section on court proceedings two court rulings were analyzed: the decision of the Appellate Court in Novi Sad in the case of Marija Miković, secretary of the Becej Association of Nature Conservation, against the newspaper „Bečejski mozaik“, which decision is not favorable for the media outlet – this case poses the question of distinction between facts and value judgments; the judgment of the Basic Court in Valjevo in the case of journalist Darija Ranković against former city official in Valjevo, Dragoljub Krstic – this is one of the cases in which Serbian judiciary responded to attacks against journalists;
• Implementation of existing laws – The Law on Electronic Media – rules for calculating fees for broadcasting radio-television program according to the old Broadcasting Law and the new Law on Electronic Media; The Law on Public Service Broadcasters – the manner in which Radio Television of Serbia (RTS) interprets the Law regarding the deadline for the election of the new director general and editor-in-chief of RTS;
• Adoption of new laws – the reasons why the adoption of the new Advertising Law, which is currently being drafted, is important for the media;
• Work of competent authorities – The Commissioner for Information of Public Importance and Personal Data Protection – the Commissioner’s assessment of the implementation of the Law on Free Access to Information of Public Importance and what future aspirations shoud be;
• Digitalization process – the reason why meetings of competent authorities with broadcasters, manufacturers and dealers of TV sets, held in September, are important, and what objections regarding the implementation of preparations for digital switchover remain valid;
• Media privatization process – the manner in which the Agency conducts processes initiating privatization of the remaining publicly owned media; which deadline for media privatization is valid – the one according to the general or specific law;
• Conclusion – the Report authors analyze the developments that marked the media sector in September 2014.

II REPORT ON THE TENTH MONITORING ROUND TABLE

10th ANEM Monitoring Rountable was held in Belgrade on 20 October 2014. The 10th ANEM Monitoring Publication was presented at the event. The Publication features articles on important media-related issues: new media laws; freedom of expression on the Internet; media financing; media as a channel for publicity of criminal proceedings. Following the presentation of the Publication by the authors of the articles, a constructive discussion was conducted on the topics covered in the Publication. The event was attended by a large number of interested parties – more than 40 participants. The report from the round table is available here.
